During the Civil War, he remained in Madrid until the end. Sentenced to thirty years in prison, he died in Carmona prison in 1940.

The monument was made by the sculptor  Jose Noja, Pepe Noja, a very active artist who has promoted various open-air sculpture museums. The work was installed in the gardens that bear the name of Besteiro in the Plaza de Santa Gema, very close to Vitruvio Street where the honoree lived. A statue not without controversy at the time of its installation that was criticized for being placed in front of the sanctuary of Santa Gema.
